Welcome to Inferno Tea Co. LLC (“Inferno Tea Co.,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of our website, online store, and services (collectively, the “Site”) and your purchase of our products.
By accessing or using the Site, or by placing an order with us, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you should not use the Site or purchase our products.

Inferno Tea Co. is a bold, spicy tea brand that specializes in jalapeño-infused teas and related products. Our blends use high-quality tea, real fruit pieces, and real jalapeño for a unique flavor and heat experience.

2. Eligibility & Account Responsibility
You may browse the Site without creating an account. If you create an account:

3. Health & Safety Disclaimer
Our products are food products and many blends are spicy. They may contain:

Our products and any statements about them are not evaluated by the U.S. Food & Drug Administration (FDA). They are not intended to diagnose, treat, cure, or prevent any disease.

If you are pregnant, nursing, have a medical condition, are sensitive to spicy foods/capsaicin, or are taking any medications, consult your healthcare provider before consuming our products.

Spicy ingredients may cause discomfort or irritation, especially for individuals sensitive to spice or with certain medical conditions.

Stop use immediately and seek medical advice if you experience any adverse reaction.
You are responsible for reviewing ingredient lists and warnings before consuming any product.
4. Orders, Pricing & Payment
4.1 Placing Orders
By placing an order on our Site, you represent that:

You are purchasing for personal use and not for resale (unless we expressly agree otherwise).

You are legally capable of entering into a binding contract.
Your order is an offer to buy products from us. We may accept or decline this offer in our sole discretion, including after an order confirmation email is sent, for reasons such as product availability, suspected fraud, or pricing errors.
If we cancel all or part of your order after payment is processed, we will issue a refund for the canceled portion.

Applicable sales taxes will be added at checkout based on the shipping address and current tax laws.
4.3 Payment Methods
We accept the payment methods shown at checkout (e.g., major credit/debit cards and digital wallets, processed by third-party payment providers). By submitting payment information, you authorize us and our payment processors to charge your selected payment method for the full order amount, including taxes and shipping.
5. Shipping Policy
5.1 Processing Time
Orders typically ship within 3–5 business days from the time your order is placed, excluding weekends and holidays. During busy periods (holidays, launches, promotions), processing may take slightly longer.
5.2 Shipping Regions & Carriers
We currently ship to United States addresses only.
Orders are shipped via USPS and/or UPS. The available shipping options and charges will be displayed at checkout and depend on factors such as order weight, destination, and chosen service level.
We do not currently offer a free shipping threshold; shipping costs are calculated at checkout.
5.3 Tracking & Delivery Issues
Once your order ships, we will provide tracking information when available. If you experience issues such as:

Delivery to the wrong address

Damage upon arrival
please contact us at keepitspicy@infernoteaco.com with your order number and details. We’ll work with you and, when appropriate, the carrier to try to resolve the issue.
6. Returns, Refunds & Exchanges
Because tea is a food product and our blends are small-batch and spicy, we have to be careful about what we accept back while still being fair.
6.1 General Return Window
Unless otherwise stated:

You must contact us about any return or exchange request within 30 days of delivery.

You can reach us at keepitspicy@infernoteaco.com with your order number and a description of the issue. We may request photos of the product and packaging.
We will review your request and let you know whether a return, refund, replacement, or store credit is appropriate.
6.2 Tea Products (Food Items)
For food safety and quality reasons:

All tea sales are generally final.

We do not accept returns or exchanges on tea just because the flavor is not to your taste (the “not your cup of tea” scenario).
However, if:

Your tea arrives damaged,
-
You receive the wrong item, or
-
You have a reasonable concern about safety or contamination,
please contact us within 30 days, and we will work with you to make it right. Depending on the situation, this may include:

Sending a replacement

Issuing a refund

Providing store credit
We may ask you not to consume the product if there is any question about its safety.
6.3 Accessories (Tumblers, Infusers, etc.)
For non-food accessories (such as tumblers, infusers, or similar items):

Items must be unused, unwashed, and in their original packaging and resellable condition.

You must contact us within 30 days of delivery for a return or exchange request.
Once we receive and inspect the returned item, we will notify you whether a refund, store credit, or exchange has been approved.
6.4 Clothing & Swag
Due to limited runs, sizing, and hygiene considerations:

Clothing and swag (apparel and similar items) are final sale and not returnable or exchangeable, except in cases of damage or our fulfillment error (wrong size/item shipped).
If an apparel item arrives damaged or incorrect, contact us within 30 days and we’ll work with you on a replacement or appropriate resolution.
6.5 Who Pays Return Shipping?
Our default approach:

If you are returning an item because you changed your mind or no longer want it (where a return is allowed, such as eligible accessories), you are responsible for the cost of return shipping. Original shipping charges are non-refundable.

If the return is due to our error (wrong item, manufacturing defect, or clearly damaged in transit), we may provide a prepaid return label or otherwise cover/reimburse reasonable return shipping costs.
We will explain your options when you contact us about your specific situation.
6.6 Refund Method & Timing
Approved refunds will be processed to your original payment method, or as store credit if that is offered and you choose it. Please allow a reasonable processing time after we receive and inspect the returned item. Your bank or card issuer may take additional time to post the refund.
7. Cancellations & Order Changes
We begin processing orders quickly to get your tea shipped in a timely manner. As a result:

We may not be able to cancel or modify an order once it has been placed.

If you need to request a change, email keepitspicy@infernoteaco.com as soon as possible with your order number, and we’ll let you know if changes are still possible.
If your order cannot be modified or canceled because it has already entered processing or shipped, you may still be able to explore options under our Returns policy (subject to those rules).
8. Intellectual Property
Unless otherwise indicated, the Site and all content on it—including logos, brand names, images, graphics, product names and descriptions, text, and other materials—are owned by Inferno Tea Co. LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may:

Access and use the Site for your personal, non-commercial use.
You may not, without our prior written permission:

Copy, reproduce, modify, distribute, display, publish, or create derivative works from any part of the Site or its content.

If you submit reviews, photos, comments, or other content (“User Content”) via the Site, email, or social media:

You grant Inferno Tea Co. a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display your User Content in connection with our business, including in marketing materials and on the Site and our social channels.

You represent and warrant that you own or control all rights in your User Content and that it does not infringe any third-party rights or violate any laws.

We may, but are not obligated to, monitor, edit, or remove User Content at our discretion.

The Site may contain links to or integrate with third-party websites or services (for example, payment processors, shipping carriers, or social networks). These third parties are not controlled by Inferno Tea Co., and we are not responsible for their content, policies, or practices.
Your use of third-party services is governed by those third parties’ terms and privacy policies.
12. Disclaimers
The Site and all products and services provided by Inferno Tea Co. are offered on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:

Any defects or errors will be corrected; or

The Site or servers are free of viruses or other harmful components.
Some jurisdictions do not allow limitations on implied warranties, so some of the above limitations may not apply to you.

To the maximum extent permitted by law, Inferno Tea Co. LLC and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to:

In no event will our total liability for all claims relating to your use of the Site and our products exceed the total amount you paid to Inferno Tea Co. for the specific product(s) at issue in the three (3) months prior to the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless Inferno Tea Co. LLC and its owners, employees, and affiliates from and against all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

Your violation of any law or the rights of any third party.
15. Governing Law & Dispute Resolution
These Terms and any dispute or claim relating to them or to your use of the Site or our products will be governed by and construed in accordance with the laws of the State of Washington, USA, without regard to its conflict of law principles.
You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in or serving King County, Washington, and you consent to the jurisdiction and venue of such courts.

We may update or modify these Terms periodically. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of the Site after any changes are posted constitutes acceptance of the revised Terms.
